This privacy policy informs about the purpose, scope and other data processing terms, as well as the rights of the data subject (“User”) arising from the use of the website https://glassesclub.eu/ (“Website”) and contractual relations with us.
We process personal data of Users in accordance with applicable laws - Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (“Regulation”), as well as other legal acts governing data protection and the right to privacy.

1. Data Controller and contact information

The Controller processes the User's personal data that the User provides when placing an order and purchasing the goods on the Website, and which the Controller collects when the User browses, uses or applies and subscribes for other services of the Website.
Your data is processed for the following purposes and on the following legal bases:
- Ordering products and services (legal basis - performance of a contract or necessary steps at the request of the User prior to entering into a contract);
- User registration or authentication (legal basis - performance of a contract or necessary steps at the request of the User prior to entering into a contract);
- Provision of information and answers to your questions, complaints, suggestions (legal basis - legitimate interests of the Controller);
- Newsletter subscription (legal basis - Consent of a data subject);
- Anonymous statistics on the use of the Website for the purposes of Website security, functionality and integrity maintenance (legal basis - legitimate interests of the Controller);
- Anonymous statistics on the use of the Website for the purposes of analytics (legal basis - Consent of a data subject);

When we process Users’ personal data, we assess the risks of confidentiality and use our organizational, financial, and technical resources, which are necessary to ensure the security of processing personal data in accordance with the principles set forth in the Regulation.
3. Data transfer outside the EU and the EEASome of our service providers may be located in countries outside the European Union which the European Commission has recognized as a country or territory, or one or more specific sectors as providing adequate protection. Such transfer does not require any special permission.
However, some of our service providers may be located in countries that are not recognized as providing adequate level of personal data protection as the EU. When transferring data to such service providers, we guarantee that we will take measures to ensure the protection of the personal data and rights of the Users, using legal tools approved in the relevant data protection legislation.
4. Recipients of personal dataUsers' personal data are processed by the Controller's employees and contractors who are authorized to work with personal data and are properly trained. Such persons process the User's data only for the purposes indicated above.
We do not disclose User’s personal data to third parties, except:
- according to the clear and undeniable consent of User;
- to persons provided for by regulatory enactments in the manner and amount established therein;
- in cases provided for by regulatory enactments for the protection of legitimate interests.
The service providers that provide us with services that include the processing of Users' personal data, belong to the following categories: payment system operators, banking services, delivery services, marketing company, companies specializing in market research and data processing, website analytics services, website hosting and maintenance, IT planning, development and management.
The Controller guarantees and ensures that such third parties process the User's data in accordance with the agreement concluded between the Controller and such third party and requirements contained therein, as well as that the Controller always cooperates only with reliable partners who ensure compliance with data protection laws and regulations.
Personal data can be transferred to and from other personal data controllers in those cases:
- E-commerce platform: we use Shopify platform, which may transfer User’s personal data to third countries, based on standard contractual clauses, required by Regulation. Please see information on data transfers: https://www.shopify.com/legal/privacy.
- Virtual try-on of glasses: we use a third party application, which collects User’s pseudonymised personal data. Privacy Policy of this service provider can be found here: https://www.fittingbox.com/en/legal-information-general-terms-and-conditions#data-privacy.
- Login and authentication using social accounts: those personal data controllers can act as login service providers and transmit personal data to the Controller; their applicable privacy policies can be found on their sites. In this case, transfer of the login data is the responsibility of each social login provider selected by User respectively.
- We use third-party services to send information and marketing materials to you, which may transfer User’s personal data to third countries. Such transfers are based on standard contractual clauses, required by Regulation and have additional contractual measures. We store Users' personal data for a limited period of time, which varies depending on the purpose of the data processing. After this period, the personal data of the Users will be permanently deleted or anonymized.
We store the received personal data until:
- Data is necessary for the purpose for which it was obtained (for example, to fulfill User's order);
- The User or the Controller can exercise their legitimate interests in the manner prescribed by regulatory enactments (for example, to file objections or to initiate legal proceedings);
- There is a legal obligation to store personal data (for example, data related to payments for purchased goods or services);
- User’s consent to the corresponding processing of personal data is valid unless there is another legal basis for the processing.
Users' personal data is stored in accordance with the following rules and criteria:
- data collected for the conclusion and performance of contracts for the purchase of goods or services, including payment data: will be stored and processed in order to fulfill the contract, as well as for as long as is necessary to fulfill the requirements of the relevant regulatory enactments (10 years);
- data of registered Users: will be stored for as long as the User has an account registered on the Website and the following 2 years;
- data collected in connection with the newsletter subscription: will be stored until the User unsubscribes from the newsletters;
- data related to User requests to our customer service: will be stored for as long as the User has an account registered on the Website.
In addition, with respect to certain personal data of the User, the Controller has a legal obligation to keep this data even after the User's account is no longer registered on the Website. In this case, the Controller retains only the data that is necessary and only for the purpose of complying with its legal or regulatory requirements, resolving disputes, preventing fraud and abuse of the Website.
We do restrict site use to 18 years or younger persons to ensure an appropriate understanding of the products or services purchased and ability to carry out financial transactions.
If it is discovered that unknowingly or due to misinformation we have collected personal data from someone under 18, or any other or unnecessary personal data was submitted, we would delete this information immediately.
The User has the right to request from the Controller access to and rectification or erasure of personal data or restriction of processing, to object to processing as well as the right to data portability. Where the processing is based on User’s consent, User has the right to withdraw consent at any time, without affecting the lawfulness of processing based on consent before its withdrawal.
If the User has reason to believe that the Controller violates the rights of the User specified by law or these rules on data processing, the User has a right to submit a complaint to the supervisory authority.
We will make commercially reasonable efforts to provide the User with reasonable access to any of his/her personal data we maintain within 1 month of receipt of User’s access request.
To ensure safety and privacy protection, we will take appropriate measures to verify User’s identity before disclosing information about the requested personal data.
